Apple Files Law Suit against Samsung for Patent and Trademark Infringement
In a US District Court in California last Friday, Apple waged an all out legal battle with the Korean smartphone manufacturer Samsung. Apple was suing Samsung for patent and trademark infringement as well as unfair competition. They were directly accusing the Korean company for copying their iOS devices.
What are the devices in question? According to Apple, the Samsung Galaxy Tab looks strikingly similar to the iPad. Not only does the tablet look exactly like Apple’s slate; it also feels exactly like it. An Apple representative added that these activities are in violation of Apple’s intellectual property.
In the courtroom, both tablets were compared to support Apple’s claim. Their argument was that Samsung was copying a number of elements, design features, and configurations. This has led them to believe that the design of the Samsung tablet was stolen.
Both of the company’s tablets are not the only devices in question here. Another device in question is Samsung’s Galaxy Ace. According to Apple, the smartphone looks exactly like and feels like their 4th generation iPhone. When put side by side, the 2 handsets do look strikingly alike.
There are mixed feelings about this legal issue between the two smartphone giants. Some believe that Samsung is guilty of copying Apple’s designs, which allows the Korean manufacturer to directly compete with iOS devices. After all, they do supply Apple with the A4 and A5 chips, which will give them access to Apple’s designs.
The other half does not think so. They feel that these features are too generic to be sued for. If Apple truly felt this way, they would have sued every phone manufacturer for copying their design. This is just like when they sued Amazon for naming their app download portal Appstore, which is similar to Apple’s App Store. It has also been argued that the term is too generic.
